Terms of Service

Welcome to MK NETSYS ENTERPRISE (Registration No. 202603163278 / 003862820-U) ("MKNetSys", "we", "us", or "our"). By using our website, purchasing our hardware, or engaging our IT services, you agree to comply with and be bound by the following Terms of Service.

1. Data Loss and Backup Liability

Client Responsibility: It is your absolute responsibility to back up all data, software, and files on your computer or device before bringing it to us or allowing our technicians to perform any service, diagnostic, or repair.

No Liability for Data Loss: MKNetSys, its technicians, and employees shall under no circumstances be liable for any loss, alteration, or corruption of data, software, or files, regardless of the cause. We do not guarantee that data can or will be recovered.

2. Hardware and Warranties

Manufacturer Warranty: All new hardware components, including those used in Custom PCs, are covered solely by their respective manufacturer warranties. MKNetSys assists in the RMA (Return Merchandise Authorization) process but does not offer independent lifetime warranties on third-party hardware.

Service Warranty: We provide a limited 30-day labor warranty on our repair and installation services. This warranty covers our workmanship but does not cover subsequent software issues, viruses, malware infections, or user-induced physical damage.

3. Limitation of Liability

To the maximum extent permitted by Malaysian law, MKNetSys shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or loss of data resulting from:

  • The use or inability to use our services or hardware.
  • Delays in service due to parts availability, shipping delays, or ISP outages.
  • Any unauthorized access to or alteration of your transmissions or data.

In any event, MKNetSys's total aggregate liability to you for all claims arising from or related to any service or hardware provided shall not exceed the total amount paid by you to MKNetSys for that specific service or hardware.

4. Payment Terms

Hardware: Full payment or a required deposit must be made upfront before any hardware components are ordered or Custom PC assembly begins.

Services: Payment for IT support, repairs, and consulting services is due immediately upon completion of the service and presentation of the invoice, unless alternative credit terms have been agreed upon in writing.

Refunds: Deposits for custom orders are non-refundable once assembly or hardware acquisition has commenced.

5. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting on this website. Your continued use of our services following the posting of revised terms means that you accept and agree to the changes.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Malaysia.
